Overview

The Zoning Board of Adjustment/Board of Appeals is a judicial board consisting of five members and three alternate members. Each member and alternate is appointed for a five-year term. This board hears citizen requests for variances from certain zoning regulations such as setback requirements and lot coverage limitations. The Zoning Board of Adjustment can grant variances based on certain criteria that constitute an undue hardship of the property.

Citizens wishing to request a variance hearing may submit their application to the Building and Planning Department at least two weeks prior to the meeting date at which the request will be heard. Findings and decisions of the Board of Aldermen cannot be appealed to any other city board or officer. However, any citizen aggrieved by a decision of the Zoning Board of Adjustment may appeal that decision to the Circuit Court of Cape Girardeau County within 30 days of the date of the board's decision.

The Zoning Board of Adjustment also serves as the Board of Appeals. As the Board of Appeals, they are granted the authority to hear and decide appeals when the citizen or person believes that an order, requirement, determination, or decision of the Building and Planning Superintendent is in error. (Exception: Public Nuisance Cases)

The Zoning Board of Adjustment meets, when requested, on the fourth Thursday of each month at 5:30 pm in the Board Chamber, City Hall, 101 Court Street. All meetings of the Zoning Board of Adjustment are open to the public and any interested citizens are welcome to attend.

The deadline for applying for a meeting is two weeks prior to the meeting date.
